| 中文摘要:《大明律》的制作修订 ,与以前的律书一样 ,充分体现了依礼制法、以礼入法、以法护礼、以法行礼的原则精神。首先 ,“明礼以导民 ,定律以绳顽”,是明洪武君臣制定《大明律》的宗旨。其次 ,《大明律》“重礼”,亦足以证明古代刑法依据礼制并维护礼制。再次 ,《大明律》及其炮制者与古代律书、礼书有很深的关系。 |
