| 中文摘要:GATT第XX(b)和(g)条可以成为WTO中除自由贸易领域之外一般领域的环境例外条款,需要满足"必需"和"保护可耗竭的自然资源"以及"非任意或公平的歧视"三个要求.从可持续发展观来看,目前WTO/GATT对"可耗竭的自然资源"的解释符合了可持续发展观,但对"必需"和"有关"的要求过于严格. |
