| 中文摘要:从产权理论出发,可以认识到财产权、知识产权的效益价值取向。这种动态效果与克服产权制度的外部性有关。就知识产权而言,通过对竞争的适度限制和对社会公众利用知识产品的保障,知识产权制可以克服消极的外部性。在实现知识产权的效益价值方面,利益平衡原则发挥了独特的作用,主要体现为利益平衡原则引领财产权的理想分配,保障了知识产权人的垄断效益和社会效益。 |
