| 中文摘要:宪法实践纷繁复杂,宪法判决形式应是一个严密完整的阶梯序列。就法律的违宪审查而言,其判决形式包括合宪判决与违宪判决两大谱系。其中,合宪判决包括纯正的合宪判决、解释性判决、警告性判决,违宪判决包括违宪宣告判决、违宪无效判决、替代性判决。上述判决形式各自对应不同的案件类型,其所彰显的审查理念,所隐含的审查结果存在较大差异。 |

| Abstract:Owe to complexity of constitution practice,the constitution decree forms should be a strict system.In the scope of law constitutional review,its decree forms include the constitutional decree and the unconstitutional decree.The former includes pure constitutionality decree,the explanatory decree and the warning decree;the later includes the unconstitutional announcement decree,the unconstitutional invalid decree and the vicarious decree.The above decree forms are respective correspondent to different cases.... |
