| 中文摘要:在我国城市化不断加速的进程中，由于拆迁正义实现不足导致大量拆迁问题，而引发了一系列社会矛盾。拆迁正义实现不足主要原因在于，作为主导拆迁的政府部门因受“政绩工程”与“土地财政”等利益驱动，导致“守夜人”的“角色异化”，最终引发强制拆迁甚至暴力拆迁。从现有“和谐拆迁”的个案看，拆迁正义是可以通过完善被拆迁人利益表达机制、建立公正补偿机制和保障程序公开透明的三个关键条件来实现的。这也为新通过的拆迁条例在今后如何实现有效实施中，提供了一个有益的借鉴。 |

| The Condition to Achieve Justice in Urban Demolition:An Empirical Study in Hefei |

| Abstract:In China's urbanization process, insufficient condition to achieve justice in demolition triggered a series of social contradictions. The main problem is the lack of justice to achieve the demolition, as the leading government departments force evictions and even demolition, motivated by the “achievement projects” and “land finance”and other benefits. From the existing case of “harmonious demolition” one can see that justice can be achieved through the improvement of mechanisms for interests expression and fair compensation. |
