| 中文摘要:经济法律规范中对 “社会公共利益”的表达方式各有不同，内涵模糊不清，公共利益的归属主体与代表主体混为一谈。由于经济的迅速发展与法的滞后性之间的矛盾，经济法不可能对公共利益给出一个定式的界定。经济法的功能在于维护权利和控制权力滥用。因此，不论社会如何变迁，经济法只要秉承经济宪政的理念，明确经济法维权与控权的目的，将公民的基本权利看作公共利益最重要的内容之一，并维护和促进其发展与实现,这本身就是公共利益的重要内容。 |

| Functionalism Regulation Anlysis on Social Public Interests in Economic Law |

| Abstract:In Economic Law regulation,there are defferent expression ways for social public interests, the ownership subject and representative subject of social public interests are confused ,and its’connotation is also ambiguous. Due to the contradiction between the rapid development of economy and the legislation’s lag, public interests can not be difined definitely. However,from the perspective of functionalism,it is found that the function of ecomonic law is to safeguard the rights and control of abusing power.Therefore,no matter how society changes,as long as economic law uphlods the spirit of ecomonic constitution, aims at the purpose of economy law’s safeguarding rights and controlling power, social public interests are liable to be protected,which is also the important content of public interests. |
