| 中文摘要:睡虎地秦简的出土，大大推动了秦律的相关研究。但秦刑事诉讼程序的实际运行，仍然缺少足够的史料佐证。岳麓书院藏秦简所见司法案例的发现，充分呈现出秦刑事诉讼程序的基本样貌。其中刑事侦查的缜密，审讯与判决的分离，以及疑难案件的奏谳，无不透露出秦刑事诉讼程序的成熟与发达。从中国古代法律制度的宏观发展历程来看，秦刑事诉讼程序的基本规定对中国后世所产生的历史影响是相当深远的，具有极其深厚的历史价值。 |

| The Historical Value of the Qin’s Criminal Procedure Seen in Qin’s Bamboo Slips Collected by Yuelu College |

| Abstract:The discovery of the Qin’s bamboo slips in Shuihudi has greatly promoted the research of the Qin’s legal system. However, we still lack sufficient historical evidence for the actual running of the Qin’s criminal procedure. The judicial cases seen in the Qin’s bamboo slips collected by Yuelu College fully show the basic appearance of the Qin’s criminal procedure. All of these, such as the thoroughness of the criminal investigation, the separation of trial and judgment and the report to their superiors when the Judicial Officials face the difficult cases, have revealed the maturity and progress of the Qin’s criminal procedure. From the angle of the macro-course of development of ancient Chinese legal system, the Qin’s criminal procedure has had a quite far-reaching historical influence upon Chinese later dynasty, and has some very deep historical value. |
