| 中文摘要:目前法学理论中尚未对外贸管制权概念进行明确定义。在不同的文本语境中，与外贸管制权相类似的用语很多，历史上所呈现的外贸管制权也具有不同的特点，作为外贸管制权形式正当性依据的法律规范更是具有多样性和复杂性。只有对外贸管制权的性质、内容进行准确界定，才能保证法理中外贸管制权的概念表述具备制度与观念上的统一性。外贸管制权实质上是一个动态的、不断生成中的法律概念。 |

| Explanation about the Legal Concept of Right of Foreign Trade Control——under the Different Text |

| Abstract:The Right of foreign trade control is not a clear and definite legal concept, which presented different characteristics in the history and was similar with some other notions. Legal Norms about foreign trade control often show variety and complexity. It is important for the right of foreign trade control to integrate legal rules and legal theory. As a generating legal concept, the right of foreign trade control originated from different texts, with determinate natures and contents. |
