| 中文摘要:环境毒物侵权诉讼是我国近年来最大宗的环境诉讼类型之一，也是最能全面反映环境污染致害过程的典型样本。在侵权法研究重心由立法论向解释论转向的背景下，通过对环境毒物致害的科学机理和法律关系的考察，能够有效检视现行环境侵权构成规范之于实践的适应性，进而发现现行环境侵权构成规范的正当性基础，从而为解释论的转向提供法理支撑。 |

| Suitability Review of Environmental Tort: A View from Environmental Toxic Damage |

| Abstract:Environmental toxic tort cases are the largest environmental cases in recent years in China, as well as the most typical sample of environmental pollution damage. With the transition of legislative doctrine to interpretative theory of tort law, by exploring the scientific basis and legal relationship of environmental toxic damage, it can effectively examine the suitability and legitimacy of existing environmental tort constituent norms, and thus provide jurisprudential support to the interpretation of environmental tort. |
