| 中文摘要:法官自由裁量权的行使充分体现了道德判断与伦理选择，因此有必要从伦理的视角对其进行考量和审视。法官的自由裁量权具有价值取向性、伦理自主性、主观能动性、自由有限性等伦理属性，以相对现实主义、司法能动主义和实现个案正义为其存在的伦理依据，其运行应当遵循彰显司法正义、彰显司法良知、讲求司法公信、符合公序良俗等伦理限度。 |

| On the ethical regulation of discretion of judges |

| Abstract:The exertion of discretion of judges embodies the moral judgment and ethical choice, so it is necessary to consider and examine from the ethical perspective. The discretion of judges has the ethical attributes of value orientation, ethical autonomy, initiative and limited freedom, its ethical basis of existence is relative to the realism, judicial activism and individual justice, its operation should follow such ethical limits as highlighting justice and judicial conscience, emphasizing the public credibility of the judiciary, in accordance with public order and good customs. |
