| 中文摘要:当前网络直播野蛮式生长的同时带来了众多的社会问题，对其进行合理有效的规制势在必行。但是，目前有关的规制制度存在明显不足，主要表现为在以下方面纠缠不清：网络直播监管对象（媒介）是电视还是互联网？监管主体是网信办、新闻出版广电总局、文化部还是信息产业部门？监管目的是规范还是发展？实际上，网络直播的监管对象应当是互联网，监管主体应当明确为网信办，监管的目的是为了促进网络产业发展。我们应该充分借鉴国外相关经验，从法律规制与社会规制两个方面入手，分层分类完善立法、明确监管内容标准、加强行业自律和技术监管，解决网络直播的制度失调问题。 |

| The System Disorders of Webcast Regulations in Our Country |

| Abstract:The webcast's rapid growth brings about many social problems , so it is necessary to carry on some reasonable and effective regulations.But there are obvious defects in the relevant regulation system.These can be summarized mainly as follows: live webcast regulation object (medium) is a TV or Internet?Supervision agency is a net letter department, general administration of press and publication, radio and television, ministry of culture and information industry department? Supervision purpose is a specification or development?In fact, the supervision of the live webcast object should be the Internet, the Supervision agency should be clear for web office letter, the purpose of regulation is to promote the development of Internet industry.We should draw lessons from foreign experience which is from two aspects of legal regulation and social regulation.Hierarchical classification of perfecting legislation. One should make the content of the regulatory standards clearly and strengthen industry self-discipline and technical supervision. Only in these way can we solve the problems of network broadcast system disorders. |
