中文摘要:职务发明报酬纠纷具有举证责任共性问题和个性问题兼备、举证能力不足问题和举证行为过错问题交织、影响举证责任的内部因素和外部因素共存的法律特征。当发明人面临举证困境时,可以借助外部证据弥补内部证据的不足,利用举证责任倒置规则平衡双方的举证能力,利用举证妨碍制度约束单位的拒不配合行为。由此,可以实现职务发明报酬纠纷举证责任的公平合理分配,激励职务发明人的研发热情。

Research on Burden of Proof in Remuneration Disputes of Service Invention
Abstract:The disputes over remuneration for service invention have some legal characteristics, for example the commonness and the individuality of burden of proof both existed, the problem of insufficient proof ability and the fault of quoting behavior are intertwined, and the coexistence of internal and external factors affect the burden of the proof. The inventors facing difficulties of the burden of proof can make use of external evidence solving the problems of insufficient internal evidence, use the inversion rule of burden of proof to balance the proof ability of both sides and use the regime of proof obstruction to restrain the unit’s uncooperative actions. Thus, it is possible to achieve the fair and equitable distribution of the burden of proof and to stimulate the enthusiasm of the inventors.
