| 中文摘要:人民政协参与立法协商之法理寓于立法的政治合法性、民主性与科学性之中。就其性质而言，人民政协参与立法协商，既是中国特色多党合作与政治协商的重要内容，是中国社会主义立法正当程序中不可或缺的政治性因素，也是人民政协履行职能的具体表现形式。在实践中，为规范和保障参与立法协商，各地方逐渐形成“四元共文模式”、“二元共文模式”和“一元独文”模式等，这些地方规范性文件的出台，为人民政协有效参与地方立法协商提供了依据。为进一步完善人民政协参与立法协商，有必要总结地方经验，在体制机制上需逐步完善人民政协参与立法协商的规范建设、组织建设和程序建设，以确保人民政协参与立法协商的规范化、常态化和多样化。 |

| The Jurisprudence and Mechanism of CPPCC Participating in Legislative Consultation |

| Abstract:The jurisprudence of CPPCC's participation in legislative consultation lies in the political legitimacy, democracy and scientificity of legislation.As far as its nature is concerned, CPPCC's participation in legislative consultation is not only an important part of multi-party cooperation and political consultation with Chinese characteristics, but also an indispensable political factor in the due process of socialist legislation, and a concrete manifestation of CPPCC's functions. In practice, in order to regulate and guarantee participation in legislative consultation, four-element model, two-element model and one-element model have gradually been formed in various localities.The promulgation of these local normative documents provides the basis for the CPPCC to effectively participate in local legislative consultation.In order to further improve the participation of the CPPCC in legislative consultation, it is necessary to sum up local experience. In terms of institutional mechanism, it is necessary to gradually improve the normative, organizational and procedural construction of the participation of the CPPCC in legislative consultation so as to ensure the standardization, normalization and diversification of the participation of the CPPCC in legislative consultation. |
