| 中文摘要:自从2000年中共十五届五中全会正式提出“文化产业”概念以来，“发展文化产业”一直是中国共产党坚定不移的重要政策导向。当前，我国在文化产业领域共制定了5部法律，22部行政法规，500多部行政规章、地方性法规和地方政府规章，其内容主要体现为“管制性内容”，我国各级政府对于文化产业的“奖助性规定”，多体现在政策性文件之中，有必要转变为正式立法。“文化产业促进法”承载着社会主义核心价值观融入法治建设的重要任务，应该成为中国文化产业领域的“基本法”“奖助法”和“一般法”，以实现“文化产业立法的法典化、规范化”，“建立文化产业管理的部门协调机制”，“确立文化产业发展的行政奖助机制”。在立法技术上，“文化产业促进法”需要坚持“能细则细，宜粗则粗”的原则，先在“总则”部分明确规定促进文化产业发展的政策框架和法制框架，再通过配套的法规、规章中具体落实该法的实施措施、实施机制等内容。 |

| On the Legislative Model of Chinese Cultural Industry—— Guided by the Core Values of Socialism |

| Abstract:The Fifth Plenary Session of the 15th Central Committee of the Communist Party of China officially put forward the concept of "cultural industry" since 2000, the "development of cultural industry" has been an unswerving and important policy orientation of the Communist Party of China. At present, our country has formulated five laws, 22 administrative regulations and more than 500 administrative rules, local laws and local administrative rules and regulations in the field of cultural industry. The content is mainly embodied in "regulatory content". The "bonus provisions" of our governments at all levels for cultural industry is mostly embodied in policy documents and needs to be transformed into formal legislation urgently. "Cultural Industry Promotion Law" bears the important task of integrating socialist core values into the construction of the law. It should become the "basic law", "awarding law" and "general law" in the field of Chinese cultural industry, in order to realize the "standardization of cultural industry legislation", "establishment of the department coordination mechanism of cultural industry management", and "establishment of Administrative Award opportunities for the development of cultural industry". In terms of legislative technology, the "Cultural Industry Promotion Law" needs to adhere to the principle of "Harmony of detailed rules and general rules". Firstly, the policy framework and legal framework for promoting the development of cultural industry should be clearly defined in the "General Principles". Then the implementation measures and implementation mechanism of the law should be specifically implemented through supporting laws and regulations. |
