| 中文摘要:检察权是现代国家出于国家治理的需要，按照权力分立的原则设立的一项专门权力，并由此形成一系列的制度安排。检察权的政治维度、社会维度、法律维度在保证国家法律的统一正确实施、保障“法律的守护人”的客观地位、实现国家治理的司法化起了重要作用。但检察权与生俱来的行政与司法的双重属性，在理论界和实践中却桎梏了其良性发展。唯有全面研究检察权制度设立运行的历史轨迹，各国发展演变的探索道路，并且立足于我国实际情况，在现代国家治理体系的整体布局中寻找检察权制度改革发展的合适途径与方式，才能抓住发展并完善我国检察权制度的历史契机，从而真正走出一条具有中国特色的检察改革道路。 |

| Three Dimensions of Procuratorial Power in Modern State Governance System |

| Abstract:The pro-curatorial power is a special power established by the modern state in accordance with the needs of state governance and in accordance with the principle of separation of powers, and thus forming a series of institutional arrangements. The modern state pro-curatorial power plays an important role in three dimensions. In the political dimension, it ensures the correct implementation of the national law. In the social dimension, it achieves fairness and justice with the objective position of "the guardian of the law." In the legal dimension, it realizes the judicialization of state governance. Therefore, the pro-curatorial power has nationality, objectivity and legality. However, the dual nature of the pro-curatorial power, which is innate in administration and judiciary, has plagued its benign development in both theoretical and practical terms. We should comprehensively study the historical trajectory of the establishment and operation of the pro-curatorial power system, the exploration path of the development of various countries, based on the actual situation in China, and the modern state governance system. In the overall layout, we should find suitable ways and means for the reform and development of the procuratorial power system, seize the historical opportunity of developing and perfecting China's pro-curatorial power system, and truly embark on a pro-curatorial reform path with Chinese characteristics. |
