中文摘要:道家的理想社会是以母系氏族社会遗风为蓝本而构建成的,比儒家的更远古,其对礼起源时间的追溯,也就更加遥远,《鹖冠子》关于礼的起源时间追溯到了天地初立的泰上成鸠时期。与儒家的礼本于人情和本于历史说不同,道家认为礼产生于对人类各种欲望的节制,这与法家的看法相似,但其本质区别在于道家从对人性的破坏这一点出发,认为礼的出现是人类社会堕落的标志,具有消极作用;而法家从现实功利性出发,认为礼的出现有效遏制了纷争,具有正面的、积极的作用。

Pre-qin Taoism on the Origin of Rites
Abstract:The Taoist ideal society is based on heritage of matriarchal society, on the more ancient time than the Confucianism, The origin of the ritual the traces is much more distant, and the Heguanzi about the origin of the ritual can be traced back to Chengjiu——The Initial Stage of Heaven and Earth. Different from the Confucian theory that rites are based on human feelings and history, Taoism holds that rites originate from the restraint of various human desires, which is similar to that of legalism. However, the essential difference lies in that Taoism starts from the destruction of human nature and holds that the appearance of rites is a sign of the degeneration of human society and has a negative effect. On the other hand, the legalists, starting from practical utility, believe that the emergence of rites has effectively contained disputes and played a positive role.
