中文摘要:对提供劳动的一方来说,所处的用工关系被认定为劳动关系最有利于实现自身利益的最大化。已达退休年龄的劳动者与用人单位之间的劳动关系认定主要看劳动者是否开始依法享受基本养老保险待遇。我国立法应当认可双重劳动关系的合法性。“互联网+”模式下企业与从业者之间的劳动关系的认定除了“从属性”标准外,还应当确立更为细致的认定标准。在校大学生在满足一定条件时可以以劳动者身份与用人单位建立劳动关系。

A Discussion on the Problem of Labor Relationship Identification
Abstract:For the party providing labor, the employment relationship is defined as the most favorable labor to maximize its own interest. The identification of Labor Relationship between the retiring age workers and the employers mainly depends on whether the employee begins to enjoy the basic endowment insurance treatment according to law. China's legislation should recognize the legitimacy of dual labor relations. In the  Internet plus  mode, the identification of Labor Relationship between enterprises and practitioners should establish more detailed criteria in addition to the  subordination  standard. Enrolled students can establish labor relations with employers as workers when they meet certain conditions.
