| 中文摘要:《北京公约》和《北京议定书》细化规制了威胁航空安全罪，体现了风险社会背景下法益保护前置化的当代刑法思潮。近年来威胁航空安全行为在我国频繁发生，对飞行安全形成了现实的危险，具有相当的社会危害性。我国刑法中没有规定威胁航空安全罪，对这类航空犯罪的处罚存在漏洞。基于对航空安全法益的保护和中国刑法国际化发展趋势的考虑，增设威胁航空安全罪具有必要性，从刑法理论关于行为概念和功能的界定角度分析，理论上具备增设威胁航空安全罪的可行性。应当在我国刑法第291条第2款之后增加 “威胁航空安全罪”，以实现履行国际航空安保公约规定的义务和合理而有效预防和惩治威胁航空安全犯罪以保障航空安全。 |

| The Establishment of the Crimes of Threatening Aviation Safety in Chinese Criminal Law——From the Perspective of the Conventions for the Crimes of Threatening International Aviation Safety |

| Abstract:The "Beijing Convention" and the "Beijing Protocol" finely regulate the crime of threatening aviation safety, and reflect the contemporary criminal law thought of pre-positioning the protection of legal interests in the context of risk society. In recent years, threats to aviation safety have occurred frequently in our country, posing a real danger to flight safety and having considerable social harm. China Criminal Law does not provide for the crime of threatening aviation safety, and there are loopholes in the punishment of such aviation crimes. Based on the protection of aviation safety legal interests and the consideration of the international development trend of China's criminal law, it is necessary to add the crime of threatening aviation safety. From the perspective of the definition of behavior concepts and functions in criminal law theory, it is theoretically feasible to add the crime of threatening aviation safety. The "crime of threatening aviation safety" should be added after paragraph 2 of Article 291 of the Criminal Law of my country to fulfill the obligations stipulated in the International Aviation Security Convention and reasonably and effectively prevent and punish crimes threatening aviation safety to ensure aviation security. |
