| 中文摘要:最高人民法院要求法官应当将待决案件与指导性案例进行相似性对比和识别。从案例指导制度初创时期的“基本案情”类似，到要求“基本事实”类似，是指导案例司法适用理念的重大进步。明确基本事实的结构要素，是实现指导案例事实类比的重要前提。基本事实的结构要素主要包括行为性质、权利义务和事实争议点。进行基本事实类比，要将行为性质、权利义务和事实争议点等进行分类类比，从而实现基本事实的类似化。 |

| On the Judgement of Basic Facts and its Similarity in Guiding Cases |

| Abstract:The Supreme People’s Court requires judges to compare and identify the similarity between pending cases and guiding cases. The process of requireing the similarity of basic cases during the initial period of the case guidance system to require the similarity of basic facts is of significant progress in the concept of judicial application of guiding cases. To clarify the structural elements of the basic facts is an important prerequisite to realize the factual analogy of the guidance cases. The structural elements of the basic facts mainly include the nature of the act, rights and obligations and the focus of the facts. To carry out the analogy of basic facts, the nature of behavior, rights and obligations and factual contentions should be classified and analogized, so as to realize the similarity of basic facts. |
