中文摘要:在“人民幸福生活是最大的人权”这一人权观念下,我国美好生活的人权证立需要跳出“义务论—目的论”二分的传统人权研究范式,反思实体主义研究倾向,回归人权作为人类解放之堡垒的批判精神。程序主义的交往权力概念为我国美好生活权的建构提供了有益借鉴。在程序主义视域中,美好生活权是人在生活世界背景下通过交往形成的共识性力量,具有丰富的交往内涵。结合我国尊重、发展和保障人权的具体实践来看,程序主义的美好生活权旨在推动人权通过中心解构和创生建构实现法治化重构,具有积极的实践意义。

Proceduralist Research on the Rights to a Good Life in China
Abstract:Under the human rights concept that “people’s good life is the greatest human right”, the human rights certification of a good life in China needs to jump out of the traditional human rights research paradigm of the “obligatory theory-teleology theory” dichotomy, it is necessary to reflect on the tendency of materialist research, and return to the critical spirit of human rights as the bastion of human liberation. From the procedural perspective, the right to a good life is a consensual power formed through communication under the background of life world, which has rich communication connotations. Combined with the specific practice of respecting, developing and protecting human rights in China, the proceduralist right to a good life aims to promote the reconstruction of human rights through central deconstruction and creative construction, which has practical significance.
