| 中文摘要:居民委员会特别法人的组织性、其自治权的权利（力）属性，及其职能公共性，决定了居民委员会作为公法人必然需要章程法律化为载体以提供强制力保障，居民委员会的职能履行现状也迫切需要章程法律化保障自治权利，同时防止内部操纵与权力滥用。章程的法律化有利于特别法人制度目标的实现。《城市居民委员会组织法》内容具备法人章程的基本要素，应作为居民委员会法人章程，结合实践需要修改组织制度与职能范围规定，加入民事主体规定以实现公、私法规范的衔接。 |

| Legalization of the Articles of Association of Residents Committee |

| Abstract:The organizational nature of the residents’ committees, the right and power of self-government, and the public nature of their functions determine that the residents’ committees, as public legal persons, need to legalize their statutes to increase their coercive power, and the inadequate exercise of the residents’ committees’ self-government rights and the failure of self-government power urgently require the legalization of their statutes to solve many problems in self-government. The content of Organic Law of the Urban Residents’ Committee has the basic elements of the charter of a legal person, and it should be supplemented and modified on the basis of the charter of a legal person, taking into account the perspective of the civil subjects of the Residents’ Committee, not only to ensure the convergence of public and private law norms, but also to respond to the needs of self-government practice. |
