| 中文摘要:聚焦近现代法律史领域，基于传统民法的社会伦理、民商合一、公私法融合知识传统，通过“实践”与“历史”视角，针对我国法律崇公抑私、重财产轻主体现状，演绎出中国法律现代性转型的知识前提与知识动力。基于中国民法自身传统和司法基因，消除结构与行动二元对立，将“实践”置于中国民法自主知识体系建构中，对民法自主知识体系建构进行历史性反思与现代性重建。中国民法自主知识体系建构需要超越“形式理性”与“实质非理性”二元对立，基于“实用道德主义”的价值取向，突出传统司法道德性表达和实用性行动的结合，在认同多元传统、共同形塑现实基础上，完成允许移植和本土并存法律制度的自主性知识建构，形成多元价值共识，实现中国法律的现代性转型与发展。 |

| Construction of the Autonomous Knowledge System of Chinese Civil Law in “Practice” and “History” |

| Abstract:Focusing on the modern legal history，this study deduces the knowledge premise and power driving the transformation of Chinese law modernity against the characteristics of Chinese law, emphasizing public interests over private interests and valuing property rights more than individual rights from the perspectives of “practice” and “history”, based on traditional civil law，social ethics，integration of civil and business, and integration of public and private law knowledge tradition. The binary opposition between structure and action is removed based on the Chinese civil law tradition and judicial heritage. The “practice” is placed at the construction of independent knowledge system of Chinese civil law to realize the historical reflection and modern reconstruction of the construction of independent knowledge system of civil law. The construction of independent knowledge system of Chinese civil law needs to transcend the “duality of formal rationality” and “substantive irrationality” and highlight the combination of traditional judicial moral expression and practical action by the value orientation of “practical moralism”. Based on the recognition of diverse traditions and co-construction of reality，the autonomous construction of knowledge in both transplanted and indigenous legal systems is realized to form the value consensus and achieve the modern transformation and development of Chinese law. |
