| 中文摘要:人工智能可以作出不同的选择或不作出选择是对其行为进行归责的前提。人类社会基础价值在人工智能选择行为归责中具有重要意义，而实践需要则为人工智能成为归责主体提供了现实根基。“预测”将人工智能选择行为归责的实践意义规定在保护固有的人类社会基础价值、防止将预测变成决定、避免人工智能掌握预测结果选择操纵权三个维度。对人工智能选择行为进行归责应当遵循从价值到实践的逻辑，既要基于选择的价值性确立无意识代入的归责方式，又要将实践中的限制性规范向价值回归以建构具有针对性的归责措施。 |

| Research on the Imputation of Artificial Intelligence’s Choice Behavior |

| Abstract:Artificial Intelligence can make different choices or does not make choices, it is the premise of imputation of its behavior. The basic value of human society has new significance in the imputation of AI choice behavior, and the need for practice provides a realistic foundation for Artificial Intelligence to become the subject of imputation. “Prediction” stipulates the practical value of Artificial Intelligence choice behavior imputation in three dimensions: protecting the inherent human basic value, preventing prediction from becoming a decision, and avoiding artificial intelligence from controlling the selection and manipulation of proediction results. The imputation of choice behavior for Artificial Intelligence should follow the logic of value to practice. It is necessary to establish an unconscious imputation method based on the value of choice, and to regress restrictive norms in practice to value in order to construct targeted imputation measures. |
