| 中文摘要:执纪执法指导性案例呈现以实践论为重点的法治化面向，其类型主要包括政策执行监督型、作风整治型、基层反腐型、内部监督型、容错免责型、纪法贯通型，具有以容错纠错激励干事创业、以业务指导保障权威高效、以体系解释促进纪法贯通的价值功能。案例以党的自我革命实践为生成基础、以一体推进“三不腐”为发展脉络、以统一纪法适用标准为发展动力。案例在事实上具有较强拘束力，应提高案例规范化水平，也要建立学习培训机制。 |

| Research on the Formation Mechanism,Value Function and Reference Application of Guiding Cases of Discipline and Law Enforcement |

| Abstract:The guiding cases of discipline enforcement and law enforcement show a legal orientation focusing on practice theory. The types mainly include policy impkmentation supervision type, style rectification type, grassroots anti-corruption type, internal supervision type, fault-tolerant exemption type, and discipline and law penetration type. It has the value function of encouraging officers to start a business with fault-tolerant and error-correcting, ensuring authority and efficiency with business guidance, and promoting discipline and law penetration with system interpretation. The case is based on the party’s self-revolutionary practice, takes the integrated promotion of “three non-corruption” as the development context, and takes the unified application standard of discipline and law as the development driving force. In fact, the case has a strong binding force. We should improve the standardization level of the case and establish a learning and training mechanism. |
