| 中文摘要:“道德高尚”作为法官职业伦理的核心范畴，集中体现了现代司法制度对法官品格修养、职业操守与公共责任的价值期待。尽管当前人民法院尚未建立以“道德高尚”为核心的职业伦理规范体系，但新时代中国法治建设与经济全球化发展已为人民法院法官之道德权威塑造奠定了历史性社会基础。从本体论维度看，法官“道德高尚”内化为法官个体的德性修养，外显为制度化的伦理要求；从认识论维度看，法官“道德高尚”作为规范性评价标准，为法官行为的正当性与合法性提供价值判断依据；从方法论维度看，法官“道德高尚”是公认的法官职业伦理核心原则，需通过完善《法官法》建立法官“道德高尚”法律原则，并遵循该原则的指导，逐步建立能够反映法官“道德高尚”职业伦理的规则体系。 |

| From Ethical Ontology to Institutional Construction：An Analysis of the Threefold Approach to Judges’“High Moral Character” |

| Abstract:As the core concept of judicial professional ethics，“high moral character” embodies the value expectations of modern judicial systems regarding judges’ personal integrity，professional conduct，and public responsibility. Although a normative system of judicial ethics centered on “high moral character” has not yet been formally established within the People’s Courts of China， the development of rule of law in the new era and the advancing process of economic globalization have laid a historic and societal foundation for shaping the moral authority of Chinese judges. From an ontological perspective， the “high moral character” of judges is internalized as individual moral cultivation and externalized as institutionalized ethical requirements. From an epistemological perspective，it functions as a normative evaluative standard，providing a value-based foundation for assessing the legitimacy and propriety of judicial conduct. From a methodological perspective，“high moral character”is recognized as a fundamental principle of judicial professional ethics，which necessitates the codification of such a principle through improvements to the Judges Law. Under the guidance of this principle，a systematic and operational ethical framework that reflects the normative meaning of “high moral character” should be gradually established. |
