| 中文摘要:《中国入世议定书》第15条到期后，欧美借“市场扭曲”“特殊市场状况”等国内法变种，持续滥用替代国制度对华发起反倾销调查，损害中国出口贸易与企业创新。研究立足大数据时代背景，探索破解该困境的技术路径与策略体系，结合WTO争端解决实践及《维也纳条约法公约》解释规则分析欧美做法的违法性，依托实证数据与案例剖析大数据在反倾销预警、证据抗辩等环节的应用价值与路径。结果表明，欧美滥用替代国制度既违反相关国际规则，又借高成本替代国选择、高肯定性裁决率遏制中国产业升级；而建立国家级反倾销大数据中心等措施可有效提升中国的应对效率与国际博弈话语权，为中国维护贸易权益、推动全球反倾销规则公平化提供数据驱动的实践与理论参考。 |

| A Study on China’s Countermeasures Against the Abuse of the Surrogate Country System by the European Union and the United States in the Big Data Era |

| Abstract:Following the expiration of Article 15 of The Protocol on China’s Accession to the WTO，the European Union and the United States have persistently abused the analogue country methodology by invoking variants rooted in their domestic laws, such as “market distortion” and “special market situation”， to initiate anti-dumping investigations against China. This practice undermines both Chinese export trade and corporate innovation. Against the backdrop of the big data era, this paper explores technical pathways and strategic frameworks to address this challenge. It analyzes the inconsistency of the EU and the US practices with WTO rules by examining relevant WTO dispute settlement jurisprudence and applying the interpretation rules of the Vienna Convention on the Law of Treaties. Furthermore, drawing on empirical data and case studies, the paper investigates the application value and implementation pathways of big data in key phases of anti-dumping proceedings, including early warning and evidentiary rebuttals. The abuse of the analogue country system by the EU and the US not only violates relevant international rules but also suppresses China’s industrial upgrading through the selection of high-cost analogue countries and maintaining high affirmative determination rates. The establishment of a national-level “Big Data Center for Anti-Dumping” and other proposed measures can effectively enhance China’s response efficiency and its discursive power in international negotiations. This study provides data-driven practical and theoretical insights for China to safeguard its trade rights and interests and to promote the fair application of global anti-dumping rules. |
