| 中文摘要:在标准必要专利许可费司法认定中，专利权人的非歧视许可义务具有合同法和反垄断法的双重法律来源。法院可以运用非歧视规则对标准必要专利许可费率的适当性加以认定。在非歧视规则的适用中，对专利许可费率差异性的认定应当考虑计算方式的多样性与可选择性、专利权人使用技术的成本因素，并解决专利许可费率透明度问题。标准必要专利许可费差异化定价具有合理事由的影响因素，包括专利许可谈判时机、专利实施成本收益和专利许可客体范围的差异性，但不应包含被许可人身份及其在产业链中所处位置。 |

| Research on the Legal Application of the Non-Discrimination Rules in Standard Essential Patent Licensing |

| Abstract:In the judicial determination of standard essential patent licensing royalties, the non-discrimination licensing obligation of patent owners has dual legal sources of contract law and antitrust law. The court may use non-discrimination rules to determine the suitability of the standard essential patent licensing royalties. In applying non-discrimination rules, the determination of differences in patent licensing fees should consider the diversity and selectivity of calculation methods, the cost of technology used by patent owners, and address the issue of transparency in patent licensing fees. The influencing factors of the reasonable basis for the differential pricing of patent licensing fees include the timing of patent licensing negotiations, the cost-benefit of patent implementation, and the differences in the scope of licensed patent objects, but should not include the identity of the licensees and their position in the industry chain. |
