中文摘要:数据知识产权登记作为开展数据产权保护的先行做法，标志着理论探索向具体实践的转变。该登记制度以劳动赋权理论、功利主义激励理论等基础理论为支撑，确立了数据作为新型知识产权客体的地位。具体而言，数据知识产权登记对象涵盖数据集合与数据产品，其核心特征表现为衍生性、来源合法性、价值性及公开性；登记主体包含原始取得的数据处理者及委托、合作处理数据情形下的相关主体；登记审查采用实质审查方式，重点评估数据来源、算法规则等数据本身的实质内容。在登记效力上，数据知识产权登记不仅具备权属证明功能，产生登记对抗和公信效力，同时表明登记主体依法享有特定范围内的排他性权益。此外，为确保数据知识产权登记制度的有效运行，应完善登记平台建设、优化与其他数据基础制度的衔接，以全面推动数据知识产权保护的体系化、高效化发展。

Construction of the Data Intellectual Property Registration System

Abstract:Data intellectual property registration is a pioneering approach to protecting data property rights, marks the transition from theoretical exploration to concrete practice. This registration system is supported by the fundamental theories such as labor empowerment theory and utilitarian incentive theory, affirming the status of data as a new type of intellectual property object. Specifically,the registration objects contain the data sets and data products, characterized by derivativeness, legitimacy, value and publicity; the registration subjects include data processors as original gainers and relevant parties in cases of entrusted or cooperative data; the registration adopts a substantive review method, focusing on evaluating the substantive content of the data itself, such as the data sources and algorithm rules. In terms of registration functions, data intellectual property rights registration not only serves as proof of ownership, but also has legal effects of registration confrontation and credibility, and demonstrates that the registration subject is legally entitled to exclusive rights within a specific scope. Additionally, to ensure the effective operation of data intellectual property registration system, it is necessary to improve the construction of the registration platform and optimize the connection with other data basic systems to comprehensively promote the systematization and efficiency of data intellectual property registration.
